The content and services provided by DEVVAANI ASTRO SOLUTIONS. SERVICES through www.DEVVAANI.com (hereinafter referred to as "We" "DEVVAANI" "us" "our" "DEVVAANI application" "Website") are subject to the terms and conditions of use (hereinafter referred to as "Terms of Usage").

MODIFICATION

The Website has the right to periodically update, amend, or change these Terms of Usage. It is the User's obligation to frequently examine the Terms of Usage to make sure that these requirements are still being followed.

USER CONSENT

You ("Member", "You," or "Your") acknowledge that you understand and expressly agree to the Terms of Usage of this Website by accessing and using it. Please do not click the "I AGREE" button if you disagree with the Terms of Usage. Before using the website, signing up, or accessing any content, data, or services within, the User is urged to carefully read the Terms of Usage. Your use of the Website and continuing use of it after any changes have been made (regardless of when they were made) constitutes your acceptance of the terms of usage and your commitment to be bound by them.

The Website, which offers astrological content, reports, data, phone (audio, video, and messaging) consultations (hereinafter referred to as "Content"), is an internet-based portal with an existence on the World Wide Web, Applications, and other electronic mediums. The website provides "Free Services" and "Paid Services" (sometimes referred to as "Services" collectively). Free services can be accessed without registering, however, to access customized astrological services, acquire extra content, or have access to paid services, you must sign up as a member of the site. A Member consents to the following by signing up for Paid Services:

  • Must respond to the Website's requests for current, comprehensive, and accurate information about himself.
  • To keep the aforementioned information accurate, current, and complete by maintaining and updating it as needed and requested by you.

REGISTRATION AND ELIGIBILITY 

The Indian Contract Act, 1872 requires that the Website User be able to enter legally enforceable contracts. In most jurisdictions, minors under the age of eighteen (18) are not allowed to use the services offered on the website without a guardian in compliance with the applicable legislation. Any abuse that might result from someone, even a juvenile, using the services offered by the website is not the responsibility of the website.

The User will be required to register as a member on the website in order to use the services, and by doing so, you (User) agree to submit up-to-date, current, and correct information when completing the sign-in form. In these Terms of Use, "Registration Data" refers to all information that you enter on the Website and all modifications thereto.

Your website ID (Your Phone Number) and password (OTP) or any log-in ID and password, such as a Facebook, Gmail, or any other legitimate email ID, could be used by you to create an account. The User hereby represents and certifies that all the information given by the User while creating an account is true, accurate, and complete, and that the User will uphold the accuracy and update the information as necessary. It is expressly forbidden to use another User's account details to access the services. The Website reserves the right to suspend or cancel the User's account and restrict or reject their future use of the Website if it is discovered that the information provided on the Website is incorrect, inaccurate, incomplete, or out of date.

The User alone is granted the right to use this website; it cannot be granted to any person or entity. Passwords and other information needed for registration reasons must be kept private, and the User is in charge of doing so. For all actions taken in connection with the User's account with the Website, the User shall bear full responsibility. The right to use this website is provided only to the User; it cannot be granted to any other person or entity. The User is responsible for keeping passwords and other information needed for registration purposes confidential. The User shall be solely responsible for all activities made in connection with the User's account with the Website.

When utilizing any service, the User must be made aware of whether the service is provided directly by the Website or by a third party. The information distributed to any third party via the Website shall not be subject to control by or monitoring by the Website.

The User acknowledges and agrees that any personal information, including without limitation debit card or credit card information, sent over the Internet may be subject to unauthorized access, hacking, theft, and/or fraud, and that neither the Website nor the Payment Service Provider(s) have any control over such issues.

The following circumstances prevent any User from using the Services provided by the Website: - 

  • If the User resides in a jurisdiction that may forbid the use of the Services provided by the Website.
  • If the User resides in a State or Country where it is illegal under the law, under a treaty, by administrative decree, or because of religious practice to engage in trade.
  • If the user has used different mobile numbers to create several accounts. The User is only allowed to have one active account per website.

ATTRIBUTE PERTAINING TO “CALL WITH ASTROLOGER”

The Website offers a service that is available through the medium of telecommunication with the Astrologer who is listed and enrolled on the Website. By consenting to the current Terms of Service, you are also providing the Website your unequivocal approval to call you on your mobile number, even if your number is on DND service supplied by your mobile service provider.



 

           WEBSITE CONTENT 

  • The Website and any specific websites that may be accessed via links on the Website are both owned by third parties.
  • These Terms of Usage must be followed for any interaction on this website, including any direct counsel or advice from a Licenced Provider, to be legal.
  • The User shall not upload or transmit through this website any content that violates or infringes in any way upon the rights of others, or any content that is an unlawful, abusive, defamatory, invasion of privacy, vulgar, obscene, profane, or otherwise objectionable, or that encourages conduct that would be illegal, give rise to legal action, or otherwise violate any law.
  • Such User shall not be permitted access to the Website and the Website shall have the right to suspend or cancel such User's access or registration.
  • The website reserves the right to change or discontinue any component or function of the website, including but not limited to content, visuals, deals, offers, settings, etc. The website also has the right to terminate access.
  • Any information other than the direction and advice obtained directly from the Third-Party Service Provider, educational materials, graphics, research sources, and other incidental information on the website, and the content generally, should not be regarded as medical advice.
  • If medical advice is offered by a third-party service provider, such as a registered astrologer on the website, it is not guaranteed by the website. An adequately qualified healthcare practitioner should always be consulted for diagnosis and treatment, as well as information on which medications or other forms of care may be suitable for the User. Nothing in the Content suggests or implies that a specific drug or course of treatment is suitable, safe, or efficient for you. No particular tests, drugs, products, or procedures are recommended by DEVVAANI.
  • By using the Website, Application, or Services, the User hereby agrees that any legal recourse or liability sought for the acts or omissions of other Members, including the service provider registered with the Website or other third parties linked with the Website, shall be restricted to a claim against the specific Member who may have caused any harm. You consent to refrain from attempting to hold the Website liable for such actions or omissions or seeking any type of legal redress from the Website.

BREACH AND TERMINATION

  • The Website reserves the right to modify, discontinue, change, or otherwise adjust the ordered services or the Account of a User registered with the Website, in whole or in part, without notifying the User. The Website may or may not give notice or give any explanation for the action it has taken.
  • If a user registers with the website and violates any of the terms outlined in these terms of usage, their registration will be immediately cancelled. If the Website is unable to verify and authenticate the Registration data or any other pertinent information provided by the User, it reserves the right to promptly cancel and take action.
  • The website believes that the user's conduct could subject it, other users, or any service providers it has links with to legal liability.
  • The Website suspects that the User has submitted false and misleading registration information, that there has been an interference with other Users or the service's administration, or that they have broken one of the Website's mentioned privacy policies.
  • You recognize and acknowledge that your relationship with the Service Provider, including the Astrologer, is restricted to that of a member of the Website, and that you exclusively act on your own behalf and for your own advantage. For any violation of the current terms of usage and the Service Terms and Conditions agreed upon between the parties at the registration of the data by such Service Provider, the Website may cancel and deactivate the Profile of such Service Provider.

         DELIVERY, CANCELLATION, AND REFUND

  • If an order has reached the "processing" (Assigned to an Astrologer) stage, then under no circumstances will a refund be performed on the order of any reports. When placing an order hastily and carelessly, the User assumes all risk and liability, and the Website is not liable for any refunds once the processing stage has begun.
  • The website's technical issues or delays that are reported during the processing of a request, including the generation of reports by the service provider, an astrologer, are not eligible for a refund. The User acknowledges that the timelines are approximations and agrees to take all necessary precautions to follow them as indicated.
  • Absolutely no philosophical, emotional, or physical treatment is intended to be replaced by the services provided or the products supplied. Regarding the veracity or accuracy of the astrological effects on human physiology caused by the stones advertised and sold on the website, the website disclaims all responsibility and obligation. The Website has no control over the products sold, and orders for such products or the use of the services must be placed at the full judgment and will of the User. In this situation, the User is urged to use caution; no refund will be given on such justifications.
  • For the purpose of using the "Call with Astrologer" service, supplying the incorrect contact number will result in no refund being processed. Once the feature has been enabled, the User is urged to keep the Contact Number in an area with full coverage and to always answer incoming calls. Any call that connects will not be subject to a refund.
  • The Website maintains the right, in its sole discretion, to refuse or cancel any order for any reason if there are any orders that it is unable to accept and must do so. The service not being available, accuracy issues, pricing information that is inaccurate, or other issues that have been noted can all lead to purchase cancellations. The amount paid for booking will be returned if the User's order is cancelled after charges have been made for the specified service.
  • Please take note: that no refunds will be offered if a consultation was inaccurate. DEVVAANI disclaims all liability for the veracity of any consultations' facts.

 

USER ACCOUNT ACCESS

In order to guarantee and maintain the high-quality services offered by the Website and to best serve the needs of the customer, the Website shall have access to the account and the information created by the User. By checking this box, the user authorises the website, its staff, agents, and any other person designated in this respect to have unrestricted access to their account. The Website shall conduct a case-by-case investigation from the records available with a view to addressing any complaints (if any) received and any suspected misuse reported. The User is urged to read the Privacy Policy's provisions regarding such records.

USER OBLIGATION

The User (which includes the astrologer and the Member Customer) is obligated to abide by the Website's privacy statement, terms and conditions, and other rules. The User affirms that he is a person and not a company or other type of legal business entity. The User has exclusive rights to utilize the services on the website. The User shall not breach any of the following terms and conditions when using the Website and participating in any kind of communication on any of the forums, including with respect to the products advertised on the Website: -

  • The User shall not post, publish, or transmit any messages that are inaccurate, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invade another's privacy, offensive, promote racism, hatred, or harm any individual or group, religion, or caste, infringes upon another's rights, including any intellectual property rights or copyright or trademark, violates or encourages any behavior that would violate any applicable law or regulation, or would give rise to any liability.
  • Any content that the User does not have the authority to make available under any law, contract, or other legal agreement is prohibited from being uploaded, posted, or otherwise made available by the User.
  • Any content that violates a third party's patent, trademark, trade secret, copyright, or other property rights may not be uploaded, posted, or otherwise made available by the User. However, the User is permitted to submit snippets of copyrighted content as long as they follow the Fair Use principles.
  • Screen names and email addresses of members who have registered on the website may not be collected by the User for the purpose of spamming, soliciting, or advertising.
  • The User is not permitted to send chain letters, junk mail, spam, emails that are not requested, or promotions or advertisements for goods or services.
  • The User is not permitted to upload or disseminate any files that are infected with viruses, have been corrupted, or contain other similar software or programmes that could impair the functionality of the Website or another person's computer.
  • The User shall not take any action that obstructs or interferes with access to the Website.
  • The User shall not use hacking, password mining, or any other illegitimate methods to attempt to gain unauthorised access to any part or feature of the Website, any other systems or networks connected to the Website, or to any of the services made available on or through the Website.
  • The User agrees not to break any currently in force laws or regulations inside or outside of India. Personal use of the services is one condition of continued use of the website, but it is not the only one.
  • Without the express written authorization of the Website, the User may not resell the Services or use them for any other commercial purpose.
  • The User agrees not to break any of the Additional terms of the website that may apply and are contained here or elsewhere, in addition to these Terms of Usage.
  • Any information or software accessed from the website may not be reverse-engineered, modified, copied, distributed, transmitted, displayed, performed, reproduced, published, licensed, used in derivative works, transferred, or sold by the User.
  • By signing up as a member of the website, the user consents to the following circumstances, which are not all-inclusive and may include services incidental to those listed below: - The user consents to receive communication from the app or website via email, SMS, or any other form of communication, including through WhatsApp Business Messages, regarding how to use the app or website.
  • The User promises not to send any illegal, harassing, libellous, abusing, threatening, harmful, vulgar, obscene, or otherwise objectionable material through the Website.
  • The User is not to send any information that could incite behaviour that would be illegal, subject them to civil liability, or otherwise violate any local, state, national, or international law or regulation. It is forbidden to make efforts to obtain unauthorized access to other computer systems.
  • The User shall not impede the use or enjoyment of the Website or Services by any other members.
  • Any misuse or abuse of the Site must be reported by the User. You must immediately notify the Website of any abuse or misuse of the Site or anything else that violates this Agreement by writing to Customer Care. When a complaint is received, the website may look into it, and if required, it may suspend or expel the member who committed the violation, abuse, or misuse without issuing a refund for the subscription money.
  • If a member makes a fraudulent complaint, that member's membership will be terminated without a refund of the monthly money.
  • Any consumer deemed to be unreasonable or abusive during their contact with the service provider, including the astrologer, may have their services terminated by the website, for any reason.
  • While the Website will make every effort to address any situation that violates the responsibilities, if it becomes uncontrollable the Website has the right to provide a formal warning moving forward. If a User repeatedly commits such infractions, the User will be completely barred from using the platform to do business. If the user has any remaining balance, it will be repaid, subject to any additional fees that may be levied for the infractions.

INDEMNIFICATION

The User is responsible for protecting and defending the Website, its parent company, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents against any and all third-party claims, liabilities, damages, and/or costs (including, but not limited to, attorney's fees) resulting from the User's use of the Services, violation of the Privacy Policy or these Terms of Service, or violation of any third party's rights, including without limitation, intellectual proper These terms of service will be advantageous to the Website's licensees, successors, and assigns.
